Woman Impaled as a Result of Texting While Driving

September 3, 2014

Texting while driving continues to pose a serious risk for auto accidents with serious personal injury. In today’s news there was a story about a mother dropping off a saxophone for her daughter at school, and texting led to her looking down only for a moment and striking an iron rail that impaled her through the buttocks and the seat behind her. Like many others who text (or whatever distraction) and drive, a moment of distraction almost killed her. You can’t take those moments back! Everyone knows that you should not drive distracted, and doing so is considered negligent, making you liable for injuries caused to others. According to the Washington Post in an article on March 30, 2013, a survey from AT&T shows adults are more likely to be driving distracted. Nearly half of adults surveyed, 49 percent, said they text and drive — a trend that appears to be on the rise, AT&T said, as six out of 10 drivers said they never texted behind the wheel just three years ago. Compare this to 43 percent of teenagers who also said they were sending messages while behind the wheel. Parents’ behavior, teenagers said, has a big influence on their own actions. AT&T found that not having a parental rule against texting and driving is among the greatest predictors that a teenager will send messages while driving. Needless to say, whether you are texting, using your phone, applying make-up, looking at directions/maps, adjusting the music, or dealing with other passengers in the car, car accidents happen, as do motorcycle accidents, truck accidents and bicycle accidents. Even in one-car accidents, a passenger may have a claim against the driver or any injuries that they suffer. Serious personal injury can result, and you will need a capable, professional and caring personal injury attorney on your side.

If you or a loved one fall victim to a car accident that you believe may have been caused by someone’s negligence, then it is imperative that you contact a Maine personal injury lawyer. You must act quickly because there is a statute of limitations that restricts the time within which you can take legal action. Don’t talk to the other party’s insurance company representative. You should rely upon an experienced Maine injury attorney to assist you in gaining legal compensation for injuries and damages that you have suffered.
